1. About these terms
These Terms & Conditions govern use of this website, product enquiries and online reservation deposits. The website is operated by CHANDLERS 1935 LTD, company number 17336166, registered in England and Wales, with its registered office at 53C Unimix House, Abbey Road, London, England, NW10 7TR.
By using the website, you agree to the sections that apply to your use. Before paying a reservation deposit, you must actively accept these terms. If you buy as a consumer, nothing in these terms limits rights that cannot lawfully be excluded. If you act wholly or mainly for business purposes, consumer-specific rights may not apply.
2. Website information is not a binding offer
Product listings are invitations to enquire or make an offer, not binding offers by CHANDLERS 1935 LTD. Sending an enquiry, starting checkout or receiving an automated acknowledgement does not create a final contract for sale.
A sales contract arises only when we confirm acceptance in writing and any further conditions stated in that confirmation are met. We may refuse or cancel a proposed transaction where stock is unavailable, information or pricing is incorrect, payment fails, identity or fraud checks are not satisfied, or the transaction cannot lawfully proceed.
3. Product descriptions and availability
We take reasonable care with descriptions, specifications, images, year, mileage, operating hours and condition. Used and ex-demonstration machinery may show wear consistent with age and use. Images may be illustrative, and colours or details can vary by screen or specification.
All products remain subject to inspection, availability and written confirmation. Please verify any characteristic essential to your purchase with our sales team before committing.
4. Prices, VAT and quotations
Prices are shown in pounds sterling unless stated otherwise. Where a price is marked ex VAT, VAT is added at the rate applying when the taxable supply is made. Delivery, registration, finance, accessories and preparation are excluded unless expressly included.
We may correct obvious pricing or content errors before accepting an order. A written quotation is valid only for the period and on the conditions stated in it.
5. Reservation deposits
Eligible product pages may allow you to pay the displayed deposit through Stripe:
- a machine is not reserved until Stripe confirms successful payment;
- a successful deposit places the machine in a reserved status while our team verifies availability and contacts you;
- the deposit is credited against the agreed purchase price if the sale completes;
- the deposit does not by itself guarantee finance, delivery, part-exchange terms or final acceptance of the sale;
- pending checkout sessions expire after the period shown during checkout; and
- duplicate, suspicious, incorrect or mismatched payments may be held for manual review.
If we cannot supply the product or decline the transaction before a final sales contract is formed, we will refund the deposit to the original payment method. Bank processing times are outside our control.
Before a final sales contract is formed, you may ask us to cancel the reservation. We will refund the deposit unless a different treatment has been clearly agreed with you in writing and is permitted by law. After a sales contract is formed, cancellation and deposit treatment follow that contract and any statutory rights.
6. Consumer cancellation and faulty goods
Consumers buying at a distance may have a statutory right to cancel within the applicable cancellation period, subject to legal exceptions. Goods must be as described, fit for purpose and of satisfactory quality as required by law. Please contact us promptly if you wish to cancel or believe goods are faulty.
These rights do not generally apply in the same way to business customers, and some goods or services may fall within statutory exceptions. We will provide any additional pre-contract information and cancellation instructions required for the particular sale.
7. Payment
Reservation deposits are processed through Stripe Checkout. You must provide accurate contact and payment information and be authorised to use the selected payment method. We do not store full card details.
The remaining balance and accepted payment methods will be set out in the final quotation, order form or invoice. Unless agreed otherwise in writing, cleared payment is required before collection or delivery.
8. Collection, delivery, title and risk
Collection or delivery dates, charges and responsibilities are agreed separately. Any date given before written confirmation is an estimate. Title to goods and responsibility for loss or damage pass as stated in the final sales contract and applicable law.
You are responsible for providing safe and accurate delivery access information and for inspecting goods as soon as reasonably possible.
9. Finance and part exchange
Any finance illustration is indicative and subject to status, lender approval and separate lender terms. We do not guarantee finance approval. Part-exchange values are subject to inspection, accurate disclosure and written acceptance.
10. Acceptable use
You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with availability, submit false information, scrape substantial data, impersonate another person or use the website unlawfully. We may restrict access and report suspected unlawful activity.
11. Intellectual property
Website content is protected by intellectual property law and may be used only for personal or internal business reference unless we give written permission. Manufacturer trade marks and third-party materials belong to their respective owners.
12. Liability
Nothing excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or non-excludable consumer rights.
Subject to that, we are not responsible for losses caused by events outside our reasonable control, use of third-party websites, or reliance on website information that you did not verify before purchase. For business users, indirect or consequential losses and loss of profit, revenue, business or anticipated savings are excluded to the fullest extent permitted by law. Any additional liability provisions in a final sales contract take priority for that sale.
13. Privacy and third-party services
Our Privacy Policy explains how we handle personal information. Stripe and other linked services operate under their own terms and privacy information. We are not responsible for third-party services outside our control.
14. Changes
We may update the website and these terms. The version accepted when you pay a reservation deposit applies to that reservation, together with any later written agreement. Changes do not retrospectively remove statutory rights.
15. Governing law and contact
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, although consumers living elsewhere retain any mandatory rights to bring proceedings in their home courts.
